Oath in gurdwara decides legal battle

An oath before the "Guru Sahib" has decided the outcome of a legal battle between warring relatives for a property in Amritsar district.

In a unique form of alternative disputes redressal, the parties had agreed to shift the dispute from the "temple of justice" to Gurdwara Nada Sahib. As the case came up for resumed hearing before the Punjab and Haryana High Court, Justice Ajay Tewari's Bench was on Wednesday told that the respondent-side took oath before Guru Granth Sahib that they had not received any money from the appellant. Senior counsel for the appellant, on instructions, "fairly" stated that the appeal may be dismissed.

The case has its genesis in an alleged agreement between the parties to sell a property. The appellant, Kashmir Singh, has all along been claiming that Rs 4.3 lakh was paid to the respondent out of the total consideration of Rs 4.6 lakh. The respondents, Narinder Pal Singh and others, were, however, claiming the agreement to sell was a forged document and "no consideration had ever passed in this respect".

During the course of hearing, senior advocate Kanwaljit Singh and Puneet Kaur Sekhon appeared on behalf of the SGPC and stated that taking of oaths was frowned upon by the Tenth Sikh Guru and the court order would foster such actions. They further stated that though the matter has been resolved, the court should be more circumspect in making such orders.
